KONSEP AL-IJARAH PADA SISTEM SEWA MENYEWA KAMAR KOS

This study aims to understand the concept of leasing (al-ijarah) in the context of sharia economic law, as well as to analyze the practice of lease agreements that apply in the Gubeng District, Surabaya City. The method used is qualitative with a literature study approach, where data is collected through documentation techniques from various literature sources, including books, journals, and relevant legal documents. The results of the study indicate that although there is awareness of the importance of written agreements in lease transactions, only 7.5% of tenants use stamped contracts. Most transactions are still carried out verbally, which has the potential to cause problems in terms of rights and obligations between owners and tenants. The discussion reveals that a clear and transparent lease agreement is very important to ensure legal certainty and avoid disputes. This study concludes that the application of sharia principles in lease agreements can improve justice and transparency in the relationship between the parties involved.
